LONDON (MarketWatch) -- BP will go to court in New Orleans on Monday for the second phase of its trial over the 2010 Deepwater Horizon oil spill in the Gulf of Mexico. The civil trial, the second of three, is expected to focus on exactly how much was spilled and whether the company could have done more to cap the leak more quickly. BP could face fines of up to $18 billion under the Clean Water Act, though the company, which has already taken more than $42 billion in spill-related charges, expects the penalties to be around $3.5 billion, according to The Wall Street Journal. Pretrial filings suggest the government will argue the leak released 4.2 million barrels of oil, while BP will put the figure at 2.45 million. The explosion at the Deepwater Horizon platform killed 11 and polluted miles of the Louisiana coastline, damaging local businesses.
