WASHINGTON (MarketWatch) -- In a video message posted on the Justice Department website on Monday, Attorney General Eric Holder said no company or individual is "too big to jail." That phrase has been used to describe the theory that financial institutions are immune from criminal prosecution even if they engage in criminal conduct due to the fear on the economy such prosecution would entail. Holder said that principle that no company or individual will be too big to jail will be reaffirmed in "weeks." Media reports recently reported that prosecutors plan to charge BNP Paribas for doing business with countries on the U.S. sanctions list and charge Credit Suisse over offering tax shelters to Americans. However, they plan to be punished in such a way that their charters aren't revoked, the reports say.
